Terms of Service / Use
LaunchPoint Advising LLC, a California Limited Liability Company (“LaunchPoint,” “we,” “us,” “our”), and the undersigned student-athlete and his or her parent or legal guardian (collectively, the “Client”) agree to the following Terms of Service:
1. Services Provided
LaunchPoint Advising provides personalized college-recruiting advising for high-school student-athletes. Our services may include:

Comprehensive evaluation of the student-athlete's academic and athletic recruiting potential

Creation or refinement of highlight video(s), scouting reports, and recruiting materials
-
Targeted exposure strategy through video distribution, email outreach, social media, and coach connections
-
Guidance on communication with college coaches, roster evaluation, school selection, and recruiting timelines
-
Advising through phone, video meetings, text, and messaging
-
Access to proprietary tools, templates, and recruiting resources
-
Ongoing support throughout the recruiting process during the contract period
The determination of which colleges, levels, and programs the athlete is marketed to is made at LaunchPoint's sole discretion based on our professional judgement.
LaunchPoint does not guarantee recruitment, roster spots, scholarships, admissions, NIL opportunities, or any specific outcome. All decisions rest solely with each college/university.
2. Client Obligations
The client agrees to:

Provide accurate and complete information including academic records, transcripts, test scores, highlight film, statistics, physical measurements, and contact information

Communicate promptly with LaunchPoint and college coaches

Maintain honesty and integrity in all materials and interactions

Follow LaunchPoint guidance in outreach, communication, and professionalism

Notify LaunchPoint of any offers, roster conversations, or major updates
Providing false, misleading, or incomplete information constitutes a breach of this agreement and may result in removal from the program.
3. Your Use of Our Services
You agree NOT to:

Use LaunchPoint services for illegal, abusive, or harmful purposes

Access or use LaunchPoint materials for commercial use, resale, or redistribution

Violate NCAA, NAIA, NJCAA, or institutional recruiting regulations
-
Harvest or copy any proprietary college-coach contact information
-
Attempt to hack, disrupt, or interfere with LaunchPoint websites, systems, or communications
-
Impersonate any LaunchPoint staff member
-
Upload or distribute harmful, defamatory, inappropriate, or copyrighted material
You agree to use LaunchPoint Advising services exclusively for your personal, non-commercial recruiting process.
4. Submission of User Materials
Clients may submit videos, photos, academic records, personal statements, and related ("User Materials"). By doing so, you represent and warrant that:

You own or have rights to use all submitted materials

The materials do not infringe any third-party rights

All information is truthful and accurate
You grant LaunchPoint a worldwide, non-exclusive, royalty-free license to use these materials for:

Evaluation
-
Recruiting outreach
-
Communications with college coaches
-
Marketing or promotional use (e.g., celebrating commitments)
-
Educational resources (removing identifying information if needed)
You release LaunchPoint from liability related to use, distribution, or disclosure of User Materials in connection with legitimate recruiting activities.
5. Intended Audience
LaunchPoint services are not directed to children under 13 years of age.
By applying for our services, you affirm you are at least 13 years old, and all agreements must be executed by a parent or legal guardian for minors.
6. Notice and Consent
The Client understands and agrees that LaunchPoint may collect, store, and distribute student-athlete information—including but not limited to name, contact information, academic data, athletic video, and biographical details—to college coaches and institutions for recruiting purposes.
The Client consents to LaunchPoint communicating directly with college coaches, schools, and athletic departments on their behalf.
The Client also consents to LaunchPoint sharing non-private recruiting outcomes (e.g., commitments, offers) for promotional purposes.
7. Disclaimer
LaunchPoint Advising offers professional guidance but does not guarantee:

Scholarship offers
-
Official or unofficial visits
-
Team placement
-
Admissions decisions
-
Playing time
-
Any specific recruiting outcome
Recruiting decisions rest exclusively with colleges/universities. The client agrees not to hold LaunchPoint liable for recruiting outcomes.
8. Waiver and Limitation of Liability
The client waves, releases, and agrees to hold harmless LaunchPoint Advising, its owners, employees, and contractors from all claims related to:

Accuracy or distribution of information

Communications made on behalf of the student-athlete
-
Recruiting outcomes or lack thereof
-
Acts of third-party institutions, coaches, or organizations
In no event shall LaunchPoint's liability exceed the amount paid by the client for services.
9. Payment Terms
By enrolling, the client agrees to pay all fees associated with the selected/agreed-upon LaunchPoint package.

Payments are accepted via credit/debit card or ACH

Full payment must be completed as agreed at checkout
-
Payment plans must be completed in full
-
The client is responsible for ensuring payment method validity
Failure to complete payments may result in cancellation/suspension of services.
10. Refunds and Cancellations
LaunchPoint Advising is a selective, limited-capacity program. Once a client secures a spot, it will be secured in that if at maximum capacity, LaunchPoint turns away other families.
For that reason, all payments are final.
There are no refunds, no cancellations, and no partial refunds, regardless of commitment status, injury, playing time, coaching changes, or any other circumstance.
This policy ensures fairness and limited availability for each class year.
11. Terms of Service
Unless otherwise specified in the Client Agreement, LaunchPoint services extend until:

The end of the student-athlete's senior year of high-school
OR
-
The timeline outlines in the purchased package
Extensions may be available upon request but are not guaranteed.
12. Governing Law
These terms shall be governed by the laws of the State of California. Any disputes shall be resolved through binding arbitration in Orange County, California.
13. Acceptance
By using LaunchPoint's services, submitting payment, or signing the Client Agreement, the client acknowledges that they have read, understood, and agreed to these Terms of Service.
